The Small Print - Abracadabra Terms & Condition
**Cancellation and Early Termination**
– In the event that a booking is cancelled, a refund will be given according to the below rules:
Bookings of 1 to 7 tents:
(i) A full refund of money paid (less a 2.5% processing fee) will be given if the booking is cancelled more than 21 days prior to the commencement of the rental period. If payment was made via credit card it can take up to 30 days for the refund to appear on the statement, depending on the card provider.
(ii) No refund will be given if the booking is cancelled within 21 days of the commencement date of the rental period.
Special Events bookings, Quoted.
(i) The $1000 deposit will be forfeited in full by the client if the booking is cancelled at any stage prior to the proposed hire period.
(ii) A credit for the paid amount will be given if the booking is cancelled more than 21 days prior to the commencement of the rental period. Credits are transferable to other
guests/clients.
(iii) No credit or refund will be given if the booking is cancelled within 21 days of the commencement date of the rental period.
(iv) In the event that Abracadabra Camping agrees to a postponement the $1000 deposit and any further payments can be transferred to the new date.
– No refund will be given if the client terminates the rental period early under any circumstances.
– In the event of adverse weather conditions, Abracadabra Camping will make every effort to fulfil any accepted bookings up to the point that it deems installation may be impossible
or unsafe. Abracadabra Camping shall under no circumstances be liable to the client for any delay, defective or non-performance under this agreement as a result of adverse weather
conditions.
– If an installation has to be postponed due to a Force Majeure, heavy winds, rain or other adverse weather conditions making tent erection impossible and/or unsafe, Abracadabra
Camping will notify the client at the earliest opportunity and an alternative date will be offered to the client. Abracadabra Camping will try to accommodate the client’s needs as far as is
practicable however Abracadabra Camping is under no obligation to offer a refund for the stay.
– In the event of adverse weather conditions (including forecast winds above 30km/h), Abracadabra Camping reserves the right to either postpone or cancel the installation due to
workplace health and safety concerns. Abracadabra Camping shall under no circumstances be liable to the client for any delay, defective or non-performance under this Agreement as a
result of adverse weather conditions. In the event of adverse weather, Abracadabra Camping reserves the right to determine whether installation shall continue, if Abracadabra Camping
determines that, for safety reasons, the installation shall not continue, this agreement will be terminated and the client shall have no claim whatsoever against Abracadabra Camping.
Abracadabra Camping is entitled to recover its reasonable costs incurred attempting to install the Goods under this clause. (see also 14.)
– If a hire is already underway and needs to be cut short due to events out of Abracadabra Camping’s control (including Covid-19 related circumstances), or work has already been
undertaken for the booking, no refund or credit will be provided. If any loss or damage is incurred that is not the fault of Abracadabra Camping, then Abracadabra Camping is released
and indemnified from any demands, costs and expenses related to the damage or loss.
– Should a campground/location become unavailable after a booking is made for whatever reason, it is the client’s responsibility to arrange an alternate location at which Abracadabra
Camping can install the hired goods. Abracadabra Camping is under no obligation to issue a refund or a postponement within 21 days of the commencement date should a
campground/location become unavailable.
– Abracadabra Camping may choose to cancel a booking at any time in writing. Notice will be given of the cancellation and a full refund given. Abracadabra Camping takes no
responsibility for any subsequent losses incurred by the client in this situation as long as the client has been fully reimbursed.
– Abracadabra Camping cannot offer refunds or cancellations/postponements for bookings that have already been postponed.
– Within 48 hours of the check-in time/date, no postponements or refunds can be given under any circumstances as work will already have been undertaken by Abracadabra Camping.
– Postponed bookings and credits may be transferred to others.
– If the QLD government imposes mandatory restrictions related to Covid-19 which prevent Abracadabra Camping from installing equipment at the location booked by the client,
Abracadabra Camping will offer a credit/postponement of the booking valid for a minimum of 3 months after restrictions lift at no charge to the client.
– Abracadabra Camping is under no obligation to offer a postponement, credit or refund to any client or guest should restrictions prevent the client/guest from attending a booking
which Abracadabra Camping is otherwise legally able to provide. This includes guests who test positive to Covid-19 and are required to isolate during the hire period.
– Whilst Abracadabra Camping will attempt to accommodate client requests, should a client request new dates for a postponed booking within the credit/postponement window
which Abracadabra Camping is unable to accommodate, Abracadabra Camping is under no obligation to issue a refund or further extension to any such credit. Any extension will be
offered only at Abracadabra Camping’s discretion.
– Abracadabra Camping recommends all clients and guests take out adequate travel/event insurance to protect themselves in these events and all other provisions of this agreement.
